Copyright & DMCA Policy
How Pixground handles copyright ownership, DMCA takedown requests, counter-notifications, and repeat infringement. We respect intellectual property rights and expect our users to do the same.
Pixground respects the intellectual property rights of creators, artists, and rights holders. We comply with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. This policy explains how we handle copyright on the platform and how to report infringement.
Copyright ownership
Creators and rights holders retain full ownership of their original works. When you upload content to Pixground, you retain your copyright. You grant Pixground a license to host and display your work as described in our Terms of Service, but we never claim ownership of content you upload.
All users must have the legal right to upload any content they submit. Uploading content you do not own or do not have permission to share is a violation of these policies and may result in account termination.
Filing a DMCA takedown notice
If you believe that content on Pixground infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the specific content on Pixground that you claim is infringing, including the URL or other information sufficient to locate the material.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Where to send DMCA notices
Send your complete DMCA takedown notice to our designated copyright agent:
- Email: [email protected]
- Subject line: "DMCA Takedown Notice"
You may also use the Report button on any wallpaper page to flag content for copyright review. Incomplete notices may not be processed.
How we respond to takedown notices
Upon receiving a valid DMCA takedown notice, Pixground will:
- Promptly remove or disable access to the allegedly infringing content.
- Notify the user who uploaded the content that it has been removed due to a copyright claim.
- Provide the uploader with information about how to file a counter-notification if they believe the removal was in error.
Counter-notification process
If you believe your content was removed by mistake or misidentification, you may file a DMCA counter-notification. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the content that was removed and the URL where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the content was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the party who filed the original takedown notice.
Send counter-notifications to [email protected] with the subject line "DMCA Counter-Notification."
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 to 14 business days, we may restore the removed content.
Repeat infringer policy
Pixground maintains a strict repeat infringer policy. We will terminate the accounts of users who are determined to be repeat infringers. Specifically:
- A first valid DMCA notice results in content removal and a warning to the account holder.
- A second valid DMCA notice results in content removal and a formal account strike.
- A third valid DMCA notice may result in permanent account termination.
We reserve the right to terminate accounts after a single instance of serious or willful infringement.
Misrepresentation warning
Under the DMCA, any person who knowingly makes a material misrepresentation in a takedown notice or counter-notification may be liable for damages, including costs and attorney fees. Do not file a DMCA notice or counter-notification unless you are the copyright owner or genuinely authorized to act on behalf of the copyright owner.
Content licensing on Pixground
Wallpapers uploaded to Pixground are made available for personal, non-commercial use by default, unless the creator specifies otherwise. Downloading a wallpaper does not transfer copyright ownership. Users must respect the rights of creators as described in our Terms of Service.
